Terms of Use

Please read these Terms of Use ("Terms," "Terms of Use") carefully before using the Drivile mobile application (the "Service").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. CRITICAL SAFETY DISCLAIMER

Your safety is your own responsibility. The Drivile application is an informational tool and driving aid; it is not a safety device.
  • No Substitute for Safe Driving: The Service is not a substitute for your full attention, judgment, and adherence to safe driving practices. The single most important factor for driving safety is an attentive driver. Always pay full attention to the road and obey all traffic laws and regulations.
  • Data Accuracy Not Guaranteed: Information provided by the Service, including but not limited to speed limits, stop sign locations, road conditions, and driving analysis, is sourced from third-party providers and is provided "as is." This data may be inaccurate, incomplete, or outdated. Do not rely solely on the Service for driving decisions. You are solely responsible for the safe operation of your vehicle.
  • Hands-Free Operation: It is dangerous and illegal in many places to interact with a mobile device while driving. You agree to use the Service in a safe and legal manner, including using hands-free features like Siri where available and appropriate.

By using this Service, you acknowledge and agree that the developer of the app is not liable for any traffic accidents, violations, fines, or damages that may occur during your use of the app.

2. The Service

Drivile provides GPS-based trip logging, driving behavior analysis, and social features to help you understand and improve your driving habits. Features may include manual and automatic trip recording, driving score calculation, speed violation detection, and the ability to connect with friends.

3. Subscriptions and Payments

Certain parts of the Service are billed on a subscription basis ("Subscription(s)").

  • Billing and Payments: Subscriptions are managed and billed through Apple's In-App Purchase system, and your purchase will be subject to Apple's applicable payment policies. Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Auto-Renewal: All subscriptions automatically renew unless you cancel them at least 24 hours before the end of the current subscription period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
  • Free Trials: We may, at our sole discretion, offer a Subscription with a free trial for a limited period. If you do not cancel before the end of the free trial, you will be automatically charged the subscription price.

4. User Accounts

To use the Service, you must register for an account. You agree to provide accurate and complete information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Data Usage and Storage

  • Data Collection: By using the Service, you consent to the collection, processing, and storage of your location data, driving behavior, and trip information as described in our Privacy Policy.
  • Analytics Consent: You consent to the collection and analysis of anonymous usage data through Firebase Analytics to improve our Service. This includes app usage patterns, feature preferences, and performance metrics.
  • Data Ownership: You retain ownership of your personal data. We process this data to provide the Service and improve our features.
  • Data Deletion: You may request deletion of your data at any time by contacting us. Deletion may result in loss of access to certain features.
  • Backup and Recovery: We implement reasonable data backup and recovery procedures, but we cannot guarantee against data loss.

5A. Location Access and Permissions

Drivile relies on location services and motion activity to provide core functionality such as auto-trip detection, trip logging, speed monitoring, and navigation-related features. We follow platform guidelines and respect your choices. The following explains when and why we access these signals:

Foreground Usage (When App Is Open)

  • When In Use Access: While the app is in the foreground, we access your location to display your current position, render maps, show speed and speed limits, and enable navigation-related capabilities.
  • No Continuous Background Requirement: Foreground usage does not imply background tracking. If you close/minimize the app and have not enabled auto-trip tracking, continuous location updates stop.

Background Usage (When App Is Closed or In Background)

  • Conditional Background Tracking: Background location access occurs only when Auto Trip Tracking is enabled and motion activity indicates that you are driving, or when a manual trip is actively in progress.
  • Motion-Gated: We use motion signals (e.g., automotive vs. stationary) to start/stop background tracking. If you are stationary, background tracking is paused.
  • Trip Boundaries: Background tracking stops automatically when the trip ends (detected via motion/activity signals or when you manually end a trip).

Motion & Fitness Permissions

  • Purpose: Motion activity (e.g., automotive vs. stationary) helps detect when to start/stop auto trips without requiring constant location polling.
  • User Control: You can disable motion access in system settings. If disabled, auto-trip detection may not function as intended.

User Controls and Transparency

  • Toggles in App: You can enable/disable Auto Trip Tracking, Sound Alerts, Friend Alerts, Use Google Maps UI, and other features. Changes take effect in real time.
  • System Settings: You can change Location (Never / Ask Next Time / While Using / Always) and Motion & Fitness permissions at any time in iOS Settings.
  • Granular Logging: The app logs toggle changes and subscription context to improve user support and transparency (no sale of personal data).

Data Handling, Retention, and Deletion

  • Trip Data: Trip start/end, route traces, speeds, and aggregate metrics are stored to power analytics and history views.
  • Retention: We retain data for as long as your account remains active or as needed to provide the Service, unless you request deletion earlier.
  • Deletion: You may request deletion of your account and associated data through support. Deletion removes historical trip and related personal data from active systems, subject to backup and legal requirements.

Consent and Revocation

  • Consent: By enabling location permissions and app toggles, you consent to the described access patterns.
  • Revocation: You can revoke permissions in iOS Settings at any time. Certain features may degrade or stop working when permissions are revoked.

6. Third-Party Services

The Service integrates with third-party services including:

  • Apple Maps and Google Maps for navigation and location services
  • TomTom and OpenStreetMap for road data and speed limits
  • Firebase for authentication, data storage, and analytics
  • Apple's In-App Purchase system for subscriptions

These services have their own terms of service and privacy policies. We are not responsible for the content, privacy practices, or availability of these third-party services.

Analytics Services: We use Google Firebase Analytics to collect anonymous usage data. This data helps us improve the app and is processed according to Google's privacy policy. You can opt out of analytics collection through your device settings.

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm other users
  • Attempt to reverse engineer or hack the Service
  • Use the Service for commercial purposes without authorization
  • Share your account credentials with others
  • Use the Service while operating heavy machinery or in dangerous conditions

8. Intellectual Property

The Service and its original content (excluding data provided by you or other users), features, and functionality are and will remain the exclusive property of the app developer and its licensors. You retain all ownership rights to the personal data you generate through your use of the Service.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

10. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

11. Limitation of Liability

In no event shall the developer of the app, nor its advisors, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure is a result of circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, fire, labor disputes, or government actions.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of United States of America, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or class action lawsuit.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
